Montenegro to simplify seasonal employment with new law starting May 1st

The Ministry of Labor, Employment and Social Dialogue plans to introduce a new employment model starting May 1st that will simplify the hiring process for workers in seasonal or occasional jobs.

This is outlined in a draft version of the law on simplified employment for seasonal and occasional jobs in certain industries, which precisely regulates conditions for such engagements, workers’ rights, tax and contribution payments, as well as subsidies that employers can receive, according to Vijesti.

Sources from Vijesti claim that this is not the final version and that certain provisions will likely be revised before the final proposal.

It has been defined that taxes and contributions for permanent seasonal workers will be paid from the state budget, along with incentives for their employment.

In November last year, the Ministry of Labor, led by Minister Naida Nišić, announced that the law would be adopted by the end of January, ensuring that “we are ready for the next season, meaning seasonal workers will be prepared by March.”

Vijesti inquired whether the law would be adopted by the end of January, but the ministry did not specify a timeline.

“The draft law on permanent seasonal workers is currently in the final stages of negotiations with social partners, after which a public discussion will be organized. This is crucial to further improve the draft law and involve the public. The need for this law arises because Montenegro is a tourist destination with significant economic benefits, especially in the tourism sector. Therefore, the aim is to achieve more efficient employment of the domestic workforce for seasonal jobs, regulate the legislative framework to allow flexibility in this area, and actively involve all relevant institutions in implementing this activity,” the Ministry of Labor stated.

The Ministry explained that the engagement of permanent seasonal workers will be limited to the seasonal period, with the possibility of obtaining benefits during the off-season.

“Additionally, the law aims to combat the informal economy and enable more flexible workforce engagement. It provides a simplified process for the employment of individuals in seasonal and occasional jobs, including electronic registration and more efficient hiring, both for domestic and foreign workers. The law is expected to contribute to improving the business environment and the labor market in Montenegro. The Ministry is working to ensure that the law is adopted and ready for implementation by the tourist season, which will bring significant improvements in seasonal employment,” the ministry concluded.
